These terms apply when you use www.emotorad.com/uk (the "Website") or buy products from us for delivery in the United Kingdom. Please read them before placing an order. If you don't agree with them, please don't use the Website or place an order.

Nothing in these terms affects your legal rights as a consumer. For advice on your rights, you can contact Citizens Advice (England and Wales), Advice Direct Scotland, or Consumerline (Northern Ireland).

1. About us

The Website is operated by EMotorad UK ("EMotorad", "we", "us", "our").

2. Who can buy from us

You must be at least 18 years old to place an order. Our products are sold to consumers for personal use. If you are buying for a business, please contact us for trade terms.

We deliver to addresses in England, Scotland, Wales and Northern Ireland.

3. Your account

You can check out as a guest or create an account. If you create one, keep your login details private. Tell us straight away at uk@emotorad.com if you think someone else has used your account.

We may suspend or close an account if we reasonably believe it is being used for fraud or in serious breach of these terms. We will tell you why unless the law or a fraud investigation stops us. Closing an account does not affect orders you have already paid for or your legal rights.

4. Our products and prices

We try to describe and show our products accurately. Colours on screen may look slightly different in real life. Weights can vary a little depending on frame size and components. Product images are for illustration and your bike may differ slightly, for example in minor component suppliers, but it will match the description and specification.

All prices are in pounds sterling (£) and include VAT. The price you see at checkout includes all compulsory charges. Delivery charges, if any, are shown before you pay.

If we make an obvious pricing error, we will contact you before accepting your order. You can then order at the correct price or cancel for a full refund. If we have already accepted the order and the error was obvious and unmistakable, we may cancel it and refund you in full.

5. How the contract is formed

When you place an order you will get an email acknowledging it. This does not mean we have accepted it. The contract between us is formed when we email you to confirm dispatch (the "Order Confirmation").

We may decline an order, for example if the product is out of stock, we can't deliver to your address, or we can't verify payment. If we decline, we won't take payment, or we will refund you in full if payment was already taken.

6. Payment

You can pay using the methods shown at checkout, including major debit and credit cards. Payments are handled by secure third-party payment providers. We don't see or store your full card details.

7. Delivery

We aim to deliver within 3 to 7 working days of the Order Confirmation, and in any case within 30 days unless we agree a different date with you.

If we're delayed by something outside our control, we will let you know and do what we can to limit the delay. If the delay is long, you can cancel and get a refund for anything you have paid for but not received.

If nobody is available to take delivery, the courier will arrange redelivery. Please check your bike on delivery and tell us within 48 hours if it is damaged. This helps us sort things out quickly. It doesn't reduce your legal rights.

Your e-bike arrives partly assembled. Please follow the assembly guide and manual. If you are not confident, have it checked by a qualified bike mechanic before your first ride.

8. Ownership and risk

The products are our responsibility until they are delivered to you or to someone you have named to receive them. Ownership passes to you once we have received full payment.

9. Your right to cancel (14-day cooling-off period)

You can change your mind and cancel your order for any reason within 14 days of the day after you (or someone you name) receives the product. If your order arrives in separate deliveries, the 14 days run from the day after the last item arrives.

How to cancel. Email uk@emotorad.com, call +44 7877 314071. You don't have to give a reason.

Returning the product. We will arrange a collection free of charge. Please have the product ready for collection within 14 days of telling us you want to cancel.

Your refund. We will refund the price you paid, including standard delivery charges (if you chose a more expensive delivery option, we only refund the standard rate). We will refund within 14 days of collecting the product, using the same payment method you used.

Condition of the product. You may handle and inspect the product as you would in a shop. If you use it beyond that, for example riding it outdoors, and its value goes down as a result, we may reduce your refund by that amount. Please return the product with its parts, charger, battery key and packaging where possible.

Batteries must be packed as we instruct for safe transport. We will send instructions when you cancel.

10. If your product is faulty

Under the Consumer Rights Act 2015, the goods you buy must be of satisfactory quality, fit for purpose and as described. If they aren't, you have the right to:

  • Reject and get a full refund within 30 days of delivery.
  • Repair or replacement after 30 days (or within 30 days if you prefer). If a repair or replacement doesn't fix the problem, you can ask for a price reduction or a refund.
  • A refund after the first 6 months may be reduced to reflect the use you have had.

In most cases you can make a claim for up to 6 years in England, Wales and Northern Ireland, or 5 years in Scotland, depending on the fault.

To report a fault, contact uk@emotorad.com with your order number, a description and photos or video if possible. We pay the cost of returning faulty goods.

Warranty. We also give you a manufacturer's warranty, set out in the Warranty Policy on the Website. This warranty is in addition to your legal rights and does not replace them.

11. Using your e-bike in the UK

Our UK e-bikes are designed to meet the Electrically Assisted Pedal Cycle (EAPC) rules:

  • motor with a maximum continuous rated power of 250W
  • power assistance cuts out at 15.5 mph (25 km/h)
  • working pedals that propel the bike
  • throttle or walk-assist works only up to 6 km/h (4 mph) without pedalling

Riders must be at least 14 years old to ride an EAPC on public roads. You don't need a licence, registration or insurance for an EAPC, but we recommend third-party cover and a helmet.

Modifying the motor, controller, speed limiter or battery can make your bike illegal to ride on public roads without registration, tax, insurance and a licence. It may also make it unsafe and will affect your warranty.

Battery safety. Only use the charger and battery supplied or approved by us. Don't charge the battery unattended overnight, near escape routes, or if it is damaged. Follow the battery safety guidance in your manual.

12. Recycling and take-back

Electrical items and batteries must not go in household waste. When you buy a new e-bike from us, you can return a similar old item to us for free recycling. Email uk@emotorad.com and we will arrange it. We can also help you dispose of a used EMotorad battery safely.

13. Promotions, discount codes and reviews

Discount codes and promotions are subject to their own stated terms, including expiry dates. Only one code can be used per order unless we say otherwise.

Reviews on the Website come from real customers. We don't pay for, write, or selectively hide reviews.

14. Using the Website

You may use the Website for personal, lawful purposes. You must not:

  • use it for fraud or anything unlawful
  • try to access other people's accounts or our systems without permission
  • upload viruses or harmful code
  • post content that is offensive, defamatory, harassing or that infringes someone else's rights
  • scrape or copy the Website for commercial use without our written permission

We try to keep the Website available and accurate but can't guarantee it will always be available or error-free. We may update or change it at any time.

The Website may link to third-party sites. We are not responsible for their content or practices.

15. Content you send us

If you send us photos, videos, reviews or other content (for example by tagging us or entering a competition), you keep ownership of it. You give us a free, non-exclusive licence to use it on our website and social channels to promote EMotorad. Where content shows you, we will ask your permission before using it in paid advertising. You can ask us to stop using your content at any time by emailing uk@emotorad.com.

16. Intellectual property

All content on the Website, including text, images, video, logos and design, belongs to EMotorad or our licensors. EM and EMotorad are trade marks of the EMotorad group. You may not copy or use them without our written permission, except for personal, non-commercial viewing.

17. Your personal data

We handle your personal data in line with the UK GDPR and the Data Protection Act 2018. Our Privacy Policy explains what we collect, why, who we share it with, how long we keep it and your rights. Our Cookie Policy explains how we use cookies. We only send marketing emails or texts if you have agreed or the law otherwise allows, and you can unsubscribe at any time.

If you are unhappy with how we use your data, contact uk@emotorad.com. You can also complain to the Information Commissioner's Office (ico.org.uk).

18. Our liability to you

If we break these terms or fail to use reasonable care and skill, we are responsible for loss or damage you suffer that is a foreseeable result. Loss is foreseeable if it was obvious it would happen or if both of us knew it might happen when the contract was made.

We do not exclude or limit our liability for:

  • death or personal injury caused by our negligence
  • fraud or fraudulent misrepresentation
  • breach of your legal rights under the Consumer Rights Act 2015
  • defective products under the Consumer Protection Act 1987
  • anything else that cannot be limited by law

We only supply products for domestic and private use. We are not liable to you for loss of profit, business or business opportunity.

We are not responsible for delays or failures caused by events outside our reasonable control, such as extreme weather, strikes, or disruption to transport or supply. If this happens, we will tell you and try to limit the effect.

19. Complaints

If you have a problem, please contact our UK customer care team at uk@emotorad.com or +44 7877 314071. We aim to reply within 2 working days and to resolve complaints within 14 days.

If we can't resolve your complaint, you can go to court. We are not currently members of an alternative dispute resolution (ADR) scheme, but we will tell you if a suitable provider becomes available.

20. Changes to these terms

We may update these terms, for example to reflect changes in the law or our products. The terms that apply to your order are the ones on the Website when you placed it. We will post the updated version here with a new "last updated" date.

21. Other important terms

We may transfer our rights and obligations under these terms to another organisation. We will tell you if this happens and make sure your rights are not affected. You need our consent to transfer your rights to someone else.

If a court finds part of these terms invalid, the rest will still apply.

If we don't enforce a right straight away, we can still enforce it later.

Nobody else has any rights under this contract except you and us.

22. Governing law and courts

These terms are governed by the law of England and Wales. You can bring legal proceedings in the courts of England and Wales. If you live in Scotland, you can bring proceedings in Scotland. If you live in Northern Ireland, you can bring proceedings in Northern Ireland.
